Terms of Service

1. Acceptance of Terms

By accessing or using ModelBackers ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

ModelBackers is a crowdfunding platform that connects models, photographers, and backers. Creators launch photoshoot campaigns, and backers pledge funds in exchange for exclusive photo rewards. The Platform facilitates payments, campaign management, and photo delivery.

3. User Accounts

You must be at least 18 years old to create an account. By registering, you confirm that you are 18 years of age or older. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information. The Platform reserves the right to request proof of age at any time and to suspend accounts that cannot verify compliance.

4. Campaign Creators

Creators are responsible for fulfilling campaigns that reach their funding goals. This includes delivering all promised reward tiers within a reasonable timeframe. The Platform charges a 10% platform fee on successfully funded campaigns.

5. Backers and Pledges

Pledges are commitments to fund a campaign. Under the all-or-nothing model, backers are only charged if the campaign reaches its funding goal before the deadline. Pledges are not purchases; they are contributions in support of creative projects.

6. Payments and Refunds

Payments are processed through Stripe. If a campaign fails to reach its goal, no charges are made. Refunds for successfully funded campaigns are at the discretion of the campaign creator. The Platform is not responsible for disputes between creators and backers.

7. Prohibited Content

The following content is strictly prohibited on ModelBackers. Users may not upload, share, or distribute:

  • Nudity, sexually explicit material, or pornographic content of any kind
  • Suggestive, provocative, or sexually implied content, including implied nudity
  • Any content depicting individuals under the age of 18, regardless of context
  • Content featuring individuals who have not provided verified, documented consent
  • Violence, graphic imagery, or content promoting self-harm
  • Harassment, bullying, threats, or content targeting individuals or groups
  • Hate speech, discrimination, or content promoting intolerance based on race, gender, religion, sexual orientation, disability, or any other protected characteristic
  • Illegal content, including but not limited to content that violates local, state, national, or international law
  • Content that infringes on intellectual property rights, including copyrights and trademarks
  • Spam, malware, phishing, or deceptive content

The Platform reserves the right to remove any content that violates these terms and to immediately suspend or terminate accounts responsible for violations, without prior notice.

8. Age Requirements

ModelBackers enforces strict age requirements to protect all individuals involved in the creative process:

  • All users of the Platform must be at least 18 years old.
  • All individuals depicted in photos uploaded to the Platform must be at least 18 years old at the time the photos were taken.
  • Campaign creators are solely responsible for verifying and documenting the age of every individual featured in their content. Creators must maintain records of age verification (such as government-issued photo ID) for all subjects.
  • The Platform may request age verification documentation from creators at any time. Failure to provide documentation upon request may result in content removal and account suspension.

ModelBackers maintains a zero-tolerance policy for violations of these age requirements. Any violation will result in immediate account termination, removal of all associated content, and referral to the appropriate legal authorities where applicable.

9. Intellectual Property

Creators retain ownership of their content. By uploading content to the Platform, creators grant ModelBackers a limited license to display and distribute the content as necessary to operate the service. Backers receive a personal, non-commercial license to the photos they receive through their pledge tiers.

10. Limitation of Liability

ModelBackers is provided "as is" without warranties of any kind. The Platform is not liable for any indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the amount of fees you have paid to us.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or platform notification.
